Play Again T&Cs
Please review the following terms and conditions carefully before attending our Play Again event (“Event”). By participating in the Event, you agree to comply with these terms and conditions.
You shall ensure that Art Again receives all relevant information in respect of each participant expected to attend the Event no later than 24 hours before the event of any allergies, illnesses or medical conditions affecting such participant, or other specific requirements relating to the participant, of which you are or ought reasonably to be aware (“Relevant Information”). Art Again reserves the right to refuse or restrict access to any such Event to any participant for whom it believes complete and accurate Relevant Information has not been provided. You shall immediately inform Art Again of any changes to the Relevant Information or of any additional Relevant Information of which you become aware leading up to or on the day of the Event.
You shall ensure that any child attending the Event is above the age of 3 years old, and is accompanied by an adult (over the age of 18 years old) at all times. Where multiple children are attending the Event, at least 1 adult must be present to supervise up to 5 children at all times. The number of adults attending an Event does not include Art Again’s employees, agents or representatives.
ART AGAIN DOES NOT ASSUME ANY RESPONSIBILITY OR LIABILITY FOR THE SUPERVISION OF ANY PARTICIPANTS. Participants participate in the Event at their own risk. We, the event organisers; venue; and any affiliated individuals or entities shall not be held liable for any injury, loss, damage, or theft that may occur during the Event.You shall ensure that all participants adhere to the terms set out in the confirmation email. Where said terms are in conflict with the terms set out herein, these terms shall take priority.
Art Again shall only be required to provide services in respect of the number of participants and at the times specified in the confirmation email.
It is your responsibility to ensure all children attending the Event are appropriately supervised at all times pursuant to clause 2. Art Again may charge you for the costs of any damage to property of any person caused by your breach of this clause and we may charge you for the costs of providing supervision for any child or children where you are in breach of this term.
You will arrange prompt collection of the children attending the Event at the time notified to you and Art Again may charge you for its reasonable costs (including without limitation staff costs and travel expenses) related to supervising the child after the time notified to you.
It is your responsibility to ensure that the participant(s) complies with all reasonable instructions from Art Again’s employees to ensure the safety of all participants and other persons present and any other requirements. Art Again may suspend the Event or the participant’s (or any other participant’s) participation in the Event if you are in breach of this clause (and shall remain entitled to the price for our services in such circumstances).
You shall ensure that Art Again has up to date and accurate contact details for you or your appropriate authorised representative at all times during the Event.
You acknowledge and agree that Art Again may take video and photographic footage of participants attending the Event and that appropriate footage which does not compromise the safety or security of any participant may be used by Art Again for the purposes of promotion and marketing.
If the behaviour of any participant at the Event is in Art Again’s opinion unacceptable for any reason, or if in Art Again’s reasonable opinion it is not appropriate for the participant to continue the Event for any reason (whether by reason of illness, injury or otherwise at Art Again’s sole discretion):
10.1. where the participant is a child, you shall at Art Again’s request promptly collect or otherwise remove the child from the Event location. Art Again may exclude the child from any activities until he or she has been collected if in Art Again’s opinion such exclusion is necessary for the safety of the child or any other child or is otherwise in the child's best interests;
10.2. where the participant is an adult, you will at Art Again’s request remove or procure the removal of the participant in question and Art Again may suspend the Event without liability until the participant in question has been removed.The price paid for the Event and/or third-party costs paid for shall not be compromised in any of the circumstances described in clause 10. In addition, if you (or your authorised representative) are uncontactable for more than two (2) hours you will pay Art Again’s reasonable costs (including without limitation staff costs and travel expenses) related to caring for the participant.
In the event of unforeseen circumstances or insufficient attendance, we reserve the right to cancel or reschedule the Event. Participants will be notified promptly in such cases, and refunds or credits may be issued at our sole discretion.
For cancellations made by participants less than 1 week and more than 24 hours before the Event, no refunds will be issued. In the event a cancellation is made less than 1 week and more than 24 hours before the Event, we may, at our sole discretion, offer the participant a replacement slot to attend a subsequent event organised by Art Again.
For cancellations made less than 24 hours before the Event, no refunds or replacements will be provided under any circumstances.We reserve the right to modify or update these terms and conditions at any time without prior notice. It is the responsibility of participants to review the terms and conditions periodically for any changes.By attending the Event, you acknowledge that you have read, understood, and agreed to abide by these terms and conditions.
